1. Purpose
The Individual acknowledges that during their service as an employee, volunteer, intern, or contractor, they may have access to confidential, sensitive, or protected information. This Agreement exists to protect the Organization’s mission, beneficiaries, donors, staff, partners, and proprietary operations.
2. Definition of Confidential Information
“Confidential Information” includes, but is not limited to:

Donor names, contact details, and donation records

Beneficiary, survivor, client, or participant information
-
Personal stories, trauma disclosures, case details, or identifying data
-
Financial information, budgets, grants, and funding strategies
-
Internal documents, procedures, training materials, and programs
-
Marketing plans, unpublished content, and campaign strategies
-
Login credentials, internal systems, and access tools
-
Any information reasonably understood to be confidential
Confidential Information may be written, verbal, electronic, photographic, or visual.
3. Confidentiality Obligations
The Individual agrees to:

Keep all Confidential Information strictly confidential

Use Confidential Information only for authorized Organization purposes
-
Not disclose, record, photograph, screenshot, post, or share Confidential Information without written authorization
-
Protect Confidential Information from unauthorized access
-
Immediately report any suspected breach or unauthorized disclosure
4. Social Media, Photography & Media Confidentiality
The Individual agrees that:

No photos, videos, audio recordings, screenshots, or live streams involving beneficiaries, clients, survivors, donors, staff, events, or internal operations may be captured or shared without explicit written permission from the Organization

No confidential or identifying information may be shared on social media, websites, messaging apps, or personal platforms
-
This includes names, faces, voices, locations, personal stories, or indirect identifiers
-
Violation of this clause may result in immediate termination and legal action
5. Protection of Sensitive & Trauma-Informed Information (HIPAA-Style Clause)
The Individual acknowledges that the Organization may serve vulnerable populations, including but not limited to:

Survivors of trauma or domestic violence
-
Seniors, veterans, or individuals in crisis
-
Individuals receiving emotional, wellness, housing, or recovery support
The Individual agrees to:
-
Treat all personal and sensitive information with the highest level of confidentiality and respect
-
Not discuss or disclose identifying information, stories, or circumstances outside authorized organizational settings
-
Follow all applicable privacy, safety, and ethical standards
-
Understand that confidentiality applies even after service ends
6. Exclusions
Confidential Information does not include information that:
-
Is publicly available through no fault of the Individual
-
Was lawfully known prior to engagement
-
Is independently developed without use of Confidential Information
-
Is required by law to be disclosed (with prompt notice to the Organization when permitted)
7. Duration of Confidentiality
This Agreement remains in effect:
-
During the Individual’s service, and
-
For five (5) years after termination, or indefinitely for personal, survivor, or protected information as required by law.
8. Return or Destruction of Materials
Upon termination or request, the Individual agrees to return or permanently destroy all materials containing Confidential Information.
9. No Ownership Rights
Nothing in this Agreement grants ownership, license, or rights to the Organization’s intellectual property or confidential materials.
10. Breach & Remedies
Unauthorized disclosure may cause irreparable harm. The Organization may pursue injunctive relief, damages, termination, and any remedies available under law.
11. Governing Law
This Agreement shall be governed by the laws of the State of Georgia.
